General Information

At the time of placing an order, the customer acknowledges having read the general terms and conditions of sale set forth below and agrees to accept them without reservation.

Offers and Prices

The prices of our products are listed in euros, including all taxes. CADENTIA reserves the right to change these prices in the event of an increase in the VAT rate, or in the event of a typographical error or obvious publishing error.

CADENTIA also reserves the right to change its prices at any time. However, products will be billed based on the prices in effect at the time your order is confirmed. The products remain the property of CADENTIA until full payment has been received.

Our offers are valid while supplies last. The offer applies to metropolitan France, including Corsica. You acknowledge that you have read and accepted these Terms and Conditions of Sale before placing your order. By confirming your order, you therefore accept these Terms and Conditions of Sale.

Unless proven otherwise, the data recorded by the website constitutes proof of all transactions between CADENTIA and its customers.

In addition to the price of the products, you will be required to pay a flat-rate fee to cover shipping and order processing costs; the amount of this fee will be specified on the product page and on the order form before you confirm your order. This fee depends on the products ordered (weight, volume, and pricing policy).

Advance payments are not deposits.

Coupons and Discount Vouchers

To redeem a discount coupon or credit, the customer must enter and submit the discount code in the designated field when confirming the order on the shopping cart page.

Any promotions offered without the use of discount coupons are valid for only one order per household during a specified validity period and cannot be combined with other promotional offers.

Order Registration / Availability

Our product offers are valid as long as they are displayed on the website, while supplies last, excluding promotional offers specifically identified as such on the websites. If a product becomes unavailable after you place your order, we will notify you by email or phone. Your order will be automatically canceled, and no charge will be made to your account.

Each order is processed as soon as payment is received.

Payment Security & Security Verification

Online payments on this site are secured using the SSL protocol. Credit card payments are fully secured using the SSL protocol.

We use the latest encryption technologies to ensure completely secure payments. Your banking information is neither stored nor visible on our servers.

Any order confirmed by the consumer constitutes an irrevocable acceptance of the general terms and conditions of sale, which cannot be contested.

CADENTIA reserves the right to refuse to make a delivery or fulfill an order from a consumer who has not paid for a previous order in full or in part, or with whom a payment dispute is pending.

The company reserves the right to refuse an order from a suspicious or unidentifiable source. To ensure the security of transactions and address the widespread concern about preventing fraud in online sales, CADENTIA reserves the right to conduct checks on orders placed. As part of such a verification process, CADENTIA will send you an email requesting proof of address and identification.

The delivery period does not begin until the date the order is shipped, which cannot be earlier than the date the supporting documents are approved.

If no supporting documentation is provided, or if the documents submitted do not allow us to verify the identity of the person placing the order or the validity of the billing address, we will be required to cancel the order.

Installment Payments

We offer the option to pay in 3 or 4 installments through Alma.

Alma's credit service is offered for the settlement of purchases and the processing of payments, provided that the person purchasing the goods or services through Alma (“Buyer”) accepts the installment or deferred payment agreement.

Alma may charge a fee.

Any refusal by Alma to approve payment in installments or deferred payment may result in the termination of the contract for the purchase of the goods or services (“Terms and Conditions”), unless the Buyer agrees to pay the purchase amount in full.

In the event of termination of the Terms and Conditions, the installment payment or deferred payment agreement shall be automatically terminated.

If the installment or deferred payment plan used for your payment is canceled, these Terms and Conditions of Sale will be automatically terminated, unless you pay the full amount of your purchase in a lump sum through Alma. If the product has already been shipped to you, you must return it within the maximum timeframe specified in these Terms and Conditions of Sale.

Product Availability

The products offered on parfum-sur-mesure.com fall into two categories:

- Customized products: These require assembly and have variable production lead times. The average lead time ranges from 15 days to 2 months, depending on the complexity of the product to be assembled. In any case, the parties agree that the lead times indicated on the website are only approximate for customized products.

- Non-customized products: Most of these are available immediately from our warehouse. However, some products are produced in limited quantities.

If the product offered on the website is out of stock, customer service will contact the customer to inform them and offer a new delivery date or an equivalent replacement product. The customer will also have the option to request cancellation and a refund for their order.

Shipping Terms

In mainland France:

Orders are processed within 24 hours and shipped within 48 hours. The estimated delivery time is based on the date the goods are shipped. Saturdays, Sundays, and holidays should be added to the initial delivery time. Order and delivery tracking is available on the website. The average delivery time is between 2 and 5 days.

Outside metropolitan France:

Orders are processed within 24 hours and shipped within 48 hours. Delivery times vary depending on the country and delivery location. The countries and destinations we serve are automatically determined on the shopping cart page. If you are unable to select a delivery country, this means that, as far as we know, our shipping partner does not serve your country. We encourage you to contact our customer service team if necessary to confirm whether we can ship to your delivery address.

Shipping Your Packages

We use reliable, top-tier shipping partners.

In rare cases, a delivery delay or a lost package may occur. If a delivery is delayed by more than 7 days, the customer must notify customer service, which will forward the information to the shipping partner to initiate an investigation.

This investigation may take up to 21 days from the date it is initiated. If the package is found during this period, it will be immediately reshipped to the customer’s address (in most cases). If, however, the package is not found by the end of the 21-day investigation period, the carrier will consider the package lost.

In this case, CADENTIA will send the customer a replacement package at its own expense. If one or more of the products are unavailable or have been lost at that time, CADENTIA will refund the customer the amount paid for those products.

At the start of the investigation and throughout its duration, CADENTIA may request supporting documentation or evidence from the client. If such documentation is not provided, CADENTIA will be unable to continue the investigation, and any compensation will be suspended.

Receiving Your Packages

Upon receipt of the package, the customer must check its overall condition. Any issues with the delivery (damage, damaged and/or opened package, broken products, etc.) must be noted in writing as detailed reservations on the delivery slip, accompanied by your signature. Please note that the phrase “subject to unpacking” written on the delivery slip has no legal validity.

You must immediately report the issue by phone or email to customer service so that a claim can be filed with the carrier. Any claim submitted more than 48 hours after you receive your package will not be considered.

If a package is damaged, we recommend that you refuse delivery. We will send you a replacement product. Please inspect the contents of your order before opening any sealed packages. If you did not receive the correct product or if a product is missing, we will need photos of the package as well as the products in their sealed bags in order to process your claim.

Defective merchandise returned by the customer that is incomplete, worn, damaged, or soiled will not be accepted and will be returned at the customer’s expense. Products returned with shipping charges due upon delivery will be systematically refused.

After service by the customer service department, the merchandise is returned to the customer at our expense. If it turns out that the returned item was not authorized for return and/or that no defect covered by the warranty is found, no refund will be issued; if the customer wishes to have the item reshipped, the cost will be borne by the customer. Damage caused by impact is not covered by the manufacturer’s warranty.

CADENTIA reserves the right at any time to request proof of identity and proof of address for all orders in order to verify the contact information provided and prevent any fraudulent use of its various services.

Right of Withdrawal / Return Policy

For non-customized products:

In accordance with Article L.221-18 of the French Consumer Code, the customer has 14 business days from the date of receipt of the package to exercise their legal right of withdrawal—that is, to return, at their own expense, any products that are not satisfactory.

In the case of a multiple-item order—that is, an order consisting of several products—the refund period will begin on the date the customer notifies us of their intention to cancel the order.

The customer is not required to provide a reason for the cancellation; however, the customer may choose to notify CADENTIA. The customer will receive an email acknowledgment from CADENTIA confirming that the cancellation has been processed.

You will need to submit a request on our website through your personal account for the order in question. You will need to include the following form, completed and signed, in your package:

The product must be returned to CADENTIA. Please note that each item must be returned in the same condition as when it was received. New items must be returned new, unused, and complete in order for the customer to exercise their right of withdrawal. The product must be returned to the address provided.

This right of withdrawal may be exercised without penalty.

If the customer exercises the right of withdrawal, they may request a refund of the amounts paid. Following your request to withdraw, CADENTIA will, in accordance with legal provisions, process your refund within 14 days of receiving notification of your request to withdraw. If we do not receive your product or proof of shipment within this period, CADENTIA reserves the right to postpone your refund until the day we receive your product.

CADENTIA will issue your refund using the same payment method you used when you placed your order, unless the payment method does not allow for a refund. Therefore, if you paid for your order with a credit card (in a single payment or in four installments), CADENTIA will issue your refund by crediting your credit card.

Please note: In accordance with Article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised if the product ordered has been unsealed by the consumer after delivery and cannot be returned for reasons of hygiene or health protection.

For personalized products:

In accordance with Article L.221-18 of the French Consumer Code, highly personalized products cannot be returned or subject to a right of withdrawal.

Complaints

This contract is governed by French law. CADENTIA shall not be held liable for any damages of any kind—whether property damage, economic loss, or personal injury—that may result from the misuse of the products it sells.

In the event of difficulties in the performance of this contract, the customer may, before taking any legal action, seek an amicable resolution, in particular with the assistance of a professional association in the industry, a consumer association, or any other advisor of their choice.

Complaints or disputes will always be handled with attentive consideration, as good faith is always presumed on the part of anyone who takes the time to explain their situation. In the event of a dispute, the customer should first contact the company to seek an amicable resolution.

In the absence of an amicable agreement between the Parties, the dispute shall be submitted to the French courts, unless otherwise provided by law.

We would like to inform you that, as part of the amicable procedures to which any dispute must be submitted before the matter is brought before the competent courts, we may, by mutual agreement, utilize the means provided for in Directive 2013/11/EU of the European Parliament and of the Council of May 21, 2013, on the out-of-court settlement of consumer disputes, as well as those set forth in Regulation (EU) No. 524/2013 of the European Parliament and of the Council of May 21, 2013, on online dispute resolution for consumer disputes.

If a complaint cannot be resolved amicably by our Customer Service department, and in accordance with Article L612-1 of the Consumer Code, the customer may submit a complaint free of charge to the CM2C mediation service—of which CADENTIA is a member—electronically at https://cm2c.net. The mediation service may be contacted regarding any consumer dispute that has not been successfully resolved.

Unless otherwise required by mandatory statutory provisions, any dispute that cannot be resolved through amicable proceedings shall be submitted to the competent court within the jurisdiction of the Paris Court of Appeals, which shall have jurisdiction even in cases of summary proceedings, third-party claims, or multiple defendants.

Legal Warranties

Regardless of the commercial warranty, and in accordance with applicable regulations, CADENTIA undertakes to fulfill its obligations regarding the warranties attached to the products sold on its website and in its various catalogs, as set forth in the following excerpts from the Consumer Code and the Civil Code:

Consumer Code - Article L217-4
The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when such installation was the seller’s responsibility under the contract or was carried out under the seller’s responsibility.

Consumer Code - Article L217-5
To be in conformity with the contract, the goods must:
1) be fit for the purpose usually expected of similar goods and, where applicable: - correspond to the description provided by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model: - possess the qualities that a buyer may legitimately expect in light of public statements made by the seller, the manufacturer, or their representative, particularly in advertising or labeling.
2) or possess the characteristics mutually agreed upon by the parties, or be fit for any special purpose sought by the buyer, which the buyer has brought to the seller’s attention and which the seller has accepted.

Consumer Code - Article L217-7
Any lack of conformity that becomes apparent within twenty-four months of the delivery of the goods is presumed to have existed at the time of delivery, unless proven otherwise. The seller may rebut this presumption if it is incompatible with the nature of the goods or the alleged lack of conformity.

Consumer Code - Article L217-9
In the event of a lack of conformity, the buyer may choose between repair and replacement of the item. However, the seller may refuse to comply with the buyer’s choice if that choice entails a cost that is manifestly disproportionate to the other option, taking into account the value of the goods or the significance of the defect. In such a case, the seller is required to proceed, unless it is impossible to do so, with the option not chosen by the buyer.

Consumer Code—Article L217-12
The right to bring a claim for lack of conformity expires two years after the delivery of the goods.

Consumer Code—Article L217-16
When the buyer requests that the seller, during the term of the commercial warranty granted to the buyer upon the purchase or repair of a movable good, perform repairs covered by the warranty, any period during which the good is out of service for at least seven days shall be added to the remaining term of the warranty. This period begins on the date of the buyer’s request for service or on the date the item in question is made available for repair, if such availability occurs after the request for service.

Civil Code - Article 1641
The seller is liable under the warranty for hidden defects in the item sold that render it unfit for its intended use, or that so impair its use that the buyer would not have purchased it, or would have paid only a lower price for it, had the buyer known of such defects.

Civil Code - Article 1644
In the case described in Article 1641, the buyer may choose either to return the item and receive a refund of the purchase price, or to keep the item and receive a partial refund of the purchase price.

Civil Code - Article 1648
A claim arising from latent defects must be brought by the purchaser within two years of the discovery of the defect.

Civil Code—Article 2232
The postponement of the starting point, suspension, or interruption of the statute of limitations may not have the effect of extending the period of the statute of limitations beyond twenty years from the date the right arose.

When you exercise your legal right to conformity, you:

  • You have two years from the date of delivery of the property to take legal action;
  • You may choose between repair or replacement of the item, subject to the cost conditions set forth in Article L. 217-9 of the Consumer Code;
  • are not required to provide evidence of the existence of a lack of conformity in the goods during the twenty-four months following delivery of the goods;

This warranty applies regardless of any commercial warranty that may have been granted. When you assert a warranty claim against hidden defects in the item sold, you may choose between rescission of the sale or a reduction in the sale price.
